Third-country nationals with a visa for jobseeking

If your potential professional is in possession of a visa or residence permit for the purpose of seeking employment, he or she is entitled to perform trial work of up to ten hours per week. This allows you to get to know the applicant better during a trial workday and to assess the profile of the international professional.

If you wish to employ an international professional with a job-seeking visa and sign an employment contract with her or him, she or he can apply for a residence permit for qualified employment at the relevant Foreigners’ Authority in Germany without leaving the country first. It is important to note that the qualification of the international professional must correspond to the employment.

Third-country nationals within the scope of adaptation training for recognition of qualifications

The option to stay in Germany for the purpose of recognition of foreign professional qualifications can help you attracting those prospective international professionals whose foreign qualifications have not yet been fully recognised. This way, you can re-qualify and integrate them permanently into your company.

If the competent authority for the recognition procedure in Germany determines that further training is required for full recognition of the qualification, the professional can obtain a visa or residence permit for up to 18 months in Germany. For this purpose, Section 16d AufenthG (German Residence Act) applies. Further training can, for example, be an in-company training as part of an adaptation period or a language course.

During the post-qualification period, the professional can work for an unlimited period of time in a job matching his or her desired occupational profile.

Intra-corporate transfer for third-country nationals: ICT card

Your company or group of companies has a branch outside the EU and you would like to transfer professionals within these?

The ICT Directive, which has been part of the Residence Act since 2017, regulates the conditions for entry and residence of employees transferred within the company. The ICT card enables managers, professionals or trainees to work in a German branch for a set amount of time. Certain conditions apply to the application for an ICT card. These can be found in the guide "How can I recruit a qualified professional from abroad - what employers need to know" and on the website of the Federal Office for Migration and Refugees (BAMF).

The ICT card can be issued for employees, managers or specialists for 3 years. For trainees, the duration is limited to a maximum of 1 year.

IT professionals with practical knowledge from third countries

Do you run a business and need IT specialists? There is a special regulation for the recruitment of international IT professionals. According to this, applicants from third countries can obtain the approval of the BA for employment in the IT sector without the need for formal recognition of their qualifications in Germany (Section 19c (2) AufenthG (German Residence Act) in conjunction with Section 6 BeschV (German Employment Regulation)). Nursing and care professionals from abroad

If you want to recruit a nurse from abroad, you must first find out exactly which country you want to recruit from. Unlike in Germany, the nursing profession requires academic training in many countries – the recognition of professions plays an important role here.

In the Triple Win project, the International and Specialised Services in collaboration with the German Agency for International Cooperation finds work placements for nursing and care workers from the partner countries of Serbia, Bosnia-Herzegovina and the Philippines in nursing or geriatric institutions in Germany.
